1. Introduction

Welcome to QuoteSpark. These Terms and Conditions ("Terms") govern your use of our quoting platform service. By accessing or using QuoteSpark, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use our service.

2. Definitions

• "Service" refers to the QuoteSpark platform and all associated features
• "User", "you" refers to the individual or business entity using the Service
• "We", "us", "our" refers to QuoteSpark
• "Subscription" refers to your paid access to the Service

3. Account Registration

To use QuoteSpark, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You may not share your account with others or create multiple accounts.

4. Subscription and Payment

4.1 Subscription Fee

The QuoteSpark subscription costs £13 per month, billed monthly. Payment is due immediately upon signup unless a free trial is offered at the time of registration.

4.2 Payment Processing

Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

4.3 Automatic Renewal

Your subscription will automatically renew each month unless cancelled before the renewal date.

4.4 Price Changes

We reserve the right to change our pricing with 30 days' notice. Existing subscribers will be notified by email before any price increase takes effect.

All prices are exclusive of VAT unless otherwise stated.

5. 14-Day Money-Back Guarantee

We offer a 14-day money-back guarantee from the date of your initial subscription payment. This guarantee applies only to the initial subscription payment and does not apply to subsequent renewals.

To request a refund within the 14-day period:

• Contact us at support@quotespark.co.uk with your account details
• We will process your refund within 5-10 business days
• Your account will be deactivated upon refund approval

Refunds are not available after the 14-day period except at our sole discretion or as required by law.

6. Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:

• You will retain access until the end of your current billing period
• No refund will be provided for partial months (except during the 14-day guarantee period)
• Your account access will be removed upon cancellation. Certain data may be retained for a limited period in accordance with our Privacy Policy and legal obligations.
• You may export your data before cancellation

7. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Use the Service to send spam or unsolicited communications
• Reverse engineer or copy any part of the Service

8. User Responsibility for Quote Accuracy

You are solely responsible for:

• The accuracy of all quotes created using the Service
• Pricing, calculations, and information included in quotes
• Compliance with applicable laws and regulations
• VAT calculations and tax compliance
• Any contractual relationships with your clients

QuoteSpark is a tool to facilitate quote creation; we do not provide legal, financial, or tax advice.

9. Intellectual Property

The QuoteSpark service, including all software, designs, text, graphics, and other content, is owned by us and protected by intellectual property laws.

You retain ownership of the content you create (quotes, client data, etc.). By using our Service, you grant us permission to store and process this content solely for the purpose of providing the Service.

10. Service Availability

While we strive to provide reliable service:

• We do not guarantee uninterrupted or error-free service
• Scheduled maintenance may cause temporary downtime
• We are not liable for any losses resulting from service interruptions

11. Data and Privacy

Your use of QuoteSpark is also governed by our Privacy Policy. We are committed to protecting your data in accordance with UK GDPR and the Data Protection Act 2018.

12. Limitation of Liability

To the maximum extent permitted by law:

• QuoteSpark is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
• We are not liable for losses resulting from quote errors, business decisions, or client disputes

Nothing in these Terms excludes our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

13. Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• Your payment fails and is not resolved within 7 days
• We believe your account poses a security risk
• We are required to do so by law

We will provide reasonable notice before termination unless immediate action is required.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Your continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
